1. Scope and Consent.

• Send notifications related to your account and purchases, which we do to manage our contractual relationship with you, based on our legitimate interest and/or to comply with a legal obligation, to the extent such a lawful basis is required by applicable law;
• Send newsletters and promotional messages you request, which we do to manage our contractual relationship with you, to the extent such a lawful basis is required by applicable law;
• Enable you to participate in public platforms or other interactive features of the Services (such as post comments to blog entries), which we do to manage our contractual relationship with you and/or to comply with a legal obligation, to the extent such a lawful basis is required by applicable law;
• Conduct internal research and development, which we do to manage our contractual relationship with you and/or based on our legitimate interest, to the extent such a lawful basis is required by applicable law;

• Accomplish other business and reasonable internal purposes, including to determine the effectiveness of promotional campaigns and to conduct audits to verify that our internal process function as intended and to address legal, regulatory or contractual requirements, which we do to manage our contractual relationship with you, to comply with a legal obligation, and/or based on our legitimate interest, to the extent such a lawful basis is required by applicable law

Data Retention.

Your information will be retained in accordance with our data retention policy, which is designed to retain data for as long as needed or permitted in light of the purposes for which it was collected and consistent with our contractual obligations, employment obligations, and other business purposes, including global legal obligations. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide the Services to you (for example, as long as you have an account with us or keep using the Services); (ii) whether there is a legal obligation to which we are subject (for example, certain laws require us to keep records of your transactions for a certain period of time before we can delete them); or (iii) whether retention is advisable in light of our legal position (such as in regard to the applicable statutes of limitation, litigation or regulatory investigations). Service Providers: We may disclose your information to service providers who help with our business operations (such as fraud investigations, bill collection, payment processing, web hosting, product fulfillment, shipment, recruitment, employment, research, IT, to process opt-out requests, to assist us in responding to consumer requests for access, deletion, or correction of information, direct mail and email distribution, site analytics and operations). We may also share your information with legal, financial, insurance and other advisors in connection with corporate transactions, the management of our business and operations, to defend against legal claims; to investigate, prevent, or act against illegal activities, suspected fraud, situations involving potential threats to safety, or violations of onsemi’s terms of use; to protect our operations, assets, and intellectual property; to allow us to pursue appropriate legal remedies or limit damages; to pursue any reorganization, merger, sale, joint venture, assignment, transfer of assets, or other disposition of all or any portion of our business, assets, or stock; or as otherwise required by law.

Advertising Technology (“Ad Tech”) Vendors and Social Networks: On the Services, we may work with third parties to serve advertisements, provide us with data collection, reporting, and ad response measurement and assist with delivery of relevant marketing messages and advertisements. These third parties may view, set, or edit their own tracking technologies/cookies that are deployed when you visit our Services. Other Entities with your Consent. Other third parties at your specific direction.

3. Summary of Information Practices in Last 12 Months.

The following table summarizes (1) the categories of personal information that we plan to collect and have collected and disclosed within the preceding 12 months; and (2) the categories of third parties to which we disclosed personal information for our operational business purposes within the preceding 12 months. As reflected in this table, we may share your personal information with a variety of outside entities as well as with other members of the onsemi corporate family and law enforcement, as described in Section 2 above.

Sale of Personal Information: We do not sell your personal information for money but we and our business partners use tracking technologies to help us to understand our customers and visitors to the Services, to enhance your online experience, and customize our offerings in ways that may be deemed a “sale” of personal information under the California Consumer Privacy Protection Act (CCPA). This includes working with third parties such as ad networks that collect personal information via tracking technologies to personalize advertisements on and off our Services and to provide us with data collection, reporting, and ad response measurement. We do not knowingly sell the personal information of minors under 16.

We will try to comply with your request as soon as reasonably practicable.

Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the personal information provided until after the completion of such purchase or promotion).

Account holders can request access to their personal information at any time by logging into their accounts on the Services. We will verify and respond to your request consistent with applicable law, taking into account the type and sensitivity of the personal information subject to the request. You may make a request on behalf of a child who is under 13 years old if you are the child’s parent or legal guardian. If you make a Request to Delete, we may ask you to confirm your request before we delete your personal information.

Account holders can request access to their personal information at any time by logging into their accounts on the Services. As part of our verification process, we may request that you provide, as applicable, proof concerning your status as an authorized agent, which also may include:

1. Proof of your registration with the California Secretary of State to conduct business in California;
2. Proof of a power of attorney from the resident pursuant to Probate Code sections 4121-4130.

If you are an authorized agent and have not provided us with a power of attorney from the resident pursuant to Probate Code sections 4121-4130, we may also require the resident to:

1. Verify the resident’s own identity directly with us; or
2. Directly confirm with us that the resident provided you permission to make the request.

(3) “Request to Opt-Out”

We offer an opt-out from the use of cookies and other tracking technologies in connection with our Services, which may in some cases constitute the sale of your personal information under the CCPA or other privacy laws. Right to Non-Discrimination: You have the right to be free from unlawful discriminatory treatment for exercising your rights under the CCPA.

Do Not Track Signals: onsemi responds to Do Not Track signals to the extent received from a web browser.

Non-California Residents: onsemi will seek to honor requests to exercise the above rights made by non-California residents to the extent required by applicable law.

6. Communication Preferences and Marketing (Opt-out).

If you do not wish to receive marketing communications from us, you can indicate your communications preference within the direct communication from us or through your account/profile settings. You may not opt-out of administrative emails (for example, emails about your transactions or policy changes) for your registered account. We may share Personal Information with our corporate affiliates, who share our brand, for their direct marketing purposes. California's "Shine the Light" law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses' practices related to disclosing personal information to third parties for the third parties' direct marketing purposes. If you have consented to our collection of your personal data for multiple specific purposes or explicitly consented to our collection of special/sensitive categories of personal data (i.e., personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership, and the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning a natural person's sex life or sexual orientation) your consent can be withdrawn at an any time without affecting the lawfulness of processing based on consent before its withdrawal.

10. Security.

We may store and process your information in the United States and around the world. We maintain reasonable technical, physical, and administrative security measures designed to help protect the security of your personal information against loss, misuse, unauthorized access, disclosure, or alteration. It is your responsibility to make sure that your personal information you submit is accurate. If you believe that your login credentials have been compromised, please make sure to contact us as indicated in the Contact Us Section, below.

11. Children's Privacy.

The Services is a general audience site and it is not intended for individuals under the age of 16. We do not knowingly collect personal information via our websites, applications, services, or tools from users in this age group. onsemi requires that you be 18 years of age to work in any of our facilities.

12. International Transfer.

As we operate internationally, and many of our computer systems are currently based in the U.S. your personal information may be processed in the U.S. and in other parts of the world where we or our service providers have facilities. By using the Services you understand that your information will be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. onsemi’s operation of the Services is in accordance with the EU-U.S. and Swiss-U.S. Privacy Shield Principles. With respect to the processing of personal data received or transferred pursuant to the EU-U.S. and Swiss-U.S. Privacy Shield Principles, onsemi is subject to the investigatory and enforcement powers of the Federal Trade Commission.

Consistent with EU-U.S. and Swiss-U.S. Privacy Shield Principles, onsemi commits to resolve complaints on its processing of personal information. EU/EEA and Swiss individuals with inquiries or complaints regarding this Privacy Policy should first contact the Global Privacy Office at privacy@onsemi.com.

onsemi is responsible for the processing of personal data it receives under the EU-US and Swiss-US Privacy Shield Frameworks and subsequently transfers to a third party acting as an agent on its behalf.

If onsemi does not resolve your complaint, you may submit your complaint free of charge to https://www.jamsadr.com/file-an-eu-us-privacy-shield-claim, onsemi’s designated independent dispute resolution provider. Under certain conditions specified by the principles of the EU-U.S. and Swiss-U.S. Privacy Shield Framework, you may also be able to invoke binding arbitration to resolve your complaint.
